Inside the apartment were six other children, reportedly ranging in age from 2 to 14—all believed to be Gonzalez’s children. The circumstances were horrific, the allegations difficult to comprehend. Gonzalez was charged with three counts of child abuse and taken into custody.
But as investigators dug deeper, a new and even more troubling question emerged: Where was Ava Gonzalez?
The Missing Child: Layers of Deceit
Initially, police believed Gonzalez had seven children—the ones found inside her apartment. But as the investigation continued, detectives discovered evidence of an eighth child: Ava Marie Gonzalez. No one had seen Ava since she was two years old, in December 2017. She was never reported missing, and there were no school records to track her.
The search for Ava began in earnest, with detectives piecing together conflicting stories, forged documents, and testimony from family members and friends. What they found was a web of manipulation, secrecy, and unanswered questions.
Manipulation and Control: The Mother’s Methods
Those who knew Virginia Gonzalez describe her as a master manipulator—someone who kept family members divided, plotted grandmother against grandmother, and maintained strict control over her children and their environment. A former friend told Law & Crime, “She had a real good way of hiding things, being very discreet, very manipulative… She thought she had control of everybody.”
Videos from 2024 show Gonzalez partying, drinking, and smoking at clubs and bars. A tattoo visible in the footage matches her booking photo, confirming her identity.
But behind the scenes, Gonzalez’s life was unraveling. The allegations of child abuse and the mystery of Ava’s disappearance painted a picture of a woman whose need for control may have crossed into criminal territory.

The Investigation: Conflicting Stories and Forged Documents
Court records obtained by Austin’s KXAN reveal a maze of conflicting stories about Ava’s fate. Gonzalez’s firstborn son, now about 14, told detectives that Ava was given to another family when she was three. Child Protective Services (CPS) was told in 2023 that Ava had moved in with her father, supported by a document allegedly signed by one of the grandmothers. But when questioned, the grandmother denied signing the document, and the phone number listed was not hers. Police confirmed the signature and number were forged.
A former boyfriend of Gonzalez, also the father of one of her children, told police that Gonzalez claimed Ava was actually her sister’s child, living with an aunt and uncle. He also said Gonzalez referred to Ava as a “crack baby,” born premature and sickly. Hospital records, however, show that Ava was born full-term at a healthy weight.
Ava’s alleged father, living in Mexico, told investigators that Gonzalez said Ava was living with another family in San Antonio. He said he never had custody of his daughter.
The Testimony: A Brother’s Account
Perhaps the most chilling account comes from Gonzalez’s son, who was six years old at the time Ava was last seen. In a forensic interview, he described a night in a motel when he heard “really bad” screaming from the bathroom. He claimed he saw his mother violently assaulting Ava in the bathtub. When the water stopped, so did the screaming. He said he saw his mother dress Ava and put her in a car seat, thinking she was sleeping. His mother told him Ava was going to live with a new mom and dad. He never saw his sister again, and noted that his mother was “happy like a totally new person” afterward.
According to police documents, detectives believe Ava died on or around January 2, 2018, and that her death may have been caused by her mother.
The Legal Battle: Charges, Defense, and Strategy
As of this writing, Virginia Gonzalez has not been charged in connection with Ava’s disappearance or death. She faces three counts of child abuse related to the daughter found in the closet, with her jury trial slated for January 26th. Gonzalez has pleaded not guilty and rejected a plea deal of 40 years in prison, calling it “utterly absurd” through her attorney, J. Gabriel Hernandez.
In the summer of 2025, prosecutors increased Gonzalez’s bond from $75,000 to $250,000, citing ties to human smuggling and Mexico—hints at what may have happened to Ava. A disturbing phone call between Gonzalez and another inmate revealed her concern about being “locked up,” with the inmate referencing “the baby”—allegedly Ava.
Now, Austin police have filed a search warrant to obtain new evidence in connection to Ava’s case, expanding the investigation into a possible capital murder case. In Texas, intentionally causing the death of a child under ten is a capital crime.
The Defense: Allegations, Bias, and the Jury Pool
Gonzalez’s attorney has called the timing of the new search warrant “suspicious,” arguing that it was issued just two weeks before the scheduled jury trial, potentially poisoning the jury pool. He plans to file for a continuance and change of venue, claiming the state’s case is weak and that the facts are being stretched to fit a narrative intended to convict his client of a higher charge.
Trial attorney Bridget Williams told Law & Crime that while the defense has a point about the risk of bias, such requests are not often granted. The judge must decide whether the publicity surrounding the case makes it impossible to seat an impartial jury. During jury selection, potential jurors will be asked if they can set aside what they’ve heard in the media and focus solely on the evidence presented in court.

The System: How Did Ava Disappear?
One of the most disturbing aspects of the case is how Ava could have disappeared for so long without anyone noticing. With no school records and a forged document submitted to CPS, the system failed to catch the warning signs. CPS and police departments are often overburdened, with large caseloads and limited resources. In this instance, the lie that Ava was living with family was accepted, and the case moved on.
Bridget Williams noted that while such cases are rare, they do happen. “It’s just something that can happen. And in this situation, it did happen… Once it comes to light, it sounds like the police department is on top of it now and doing an investigation.”
The Prosecution: Separate Trials, Separate Crimes
Gonzalez’s child abuse trial and the investigation into Ava’s disappearance are being handled separately. Injury to a child can range from a state jail felony to a first-degree felony, depending on the circumstances and intent. If evidence supports it, Gonzalez could be charged with capital murder in Ava’s case, resulting in a separate trial.
Williams explained, “No matter what happens in this particular case, she should be brought in charge on a separate case altogether for this other individual. It’s not something that should run parallel just because it’s such a heinous crime on both ends.”
The Defense Strategy: Protecting Rights Amid Emotion
Defending Gonzalez will be a challenge. The evidence of malnourishment and alleged abuse is strong, and the emotional impact on jurors will be significant. Defense attorneys must ensure Gonzalez’s rights are protected and that the state meets its burden of proof. If Gonzalez rejected plea deals, her attorneys must prepare for a difficult trial, likely marked by graphic testimony and images.
Williams said, “Showing those kind of pictures to a jury is going to be an emotional trial. Anything that deals with the child, especially pictures that are going to be very graphic, is going to be a very emotional-based trial setting.”
